SMS Terms and Conditions (the “Agreement”)

DEFINITIONS

“You” means the person or entity who participates in or uses the “Service” in any way.

“Jocy’s,” “we,” “our,” and “us” means Jocy’s Mexican Restaurant, located at 228 S 8th St, Fowler, CA 93625, as well as any other person or entity providing the Service on our behalf.

“Service” means Jocy’s SMS text messaging program, which we use to communicate with our customers (“You”) about specials, promotions, order updates, and other restaurant news via text message to the mobile device of your choice.

ACCEPTANCE BY YOU

You may enroll in the Service by entering your phone number in a form on our website, app, or in-store device, or by texting a keyword to the number we provide. By using the Service, you agree to be bound by the terms of this Agreement. If you do not agree, you must immediately stop using the Service. Contact us if you have questions.

CHARGES

We do not separately charge you for the text messages you receive from the Service. However, message and data rates may apply from your mobile carrier under your wireless service agreement. Consult your wireless provider regarding its pricing plans.

Message Frequency: You will receive up to 4 messages per month.

Standard Rates: Message and data rates may apply depending on your mobile phone service plan.

Help & Stop: Reply HELP for help or STOP to cancel at any time.

By providing your phone number and opting in, you agree to receive text messages from Jocy’s. Consent is not required to make a purchase.

PARTICIPATING CARRIERS

The Service is available through AT&T, Verizon, T-Mobile, Sprint, MetroPCS, and other carriers. Additional carriers may be added without notice.

PARTICIPANT OPT-OUT OR HELP

You are responsible for managing the types of text messages you receive. For help, text HELP to the number you received the text from. To stop receiving texts, text STOP to the same number. You’ll receive a confirmation of your opt-out, and you will no longer receive text messages from us after that.

AUTOMATIC DIALING

We may use an automatic dialing system to deliver text messages to you. By using the Service, you consent to our use of an automatic dialing system to send text messages to the phone number you’ve provided.

RELEASES; NO WARRANTIES, RESERVATIONS

By participating, you agree to release and hold harmless Jocy’s and its representatives, agents, successors, assigns, employees, officers, and owners from any and all liability for loss, harm, damage, injury, cost, or expense of any kind — including property damage, personal injury, and/or death — arising in connection with the Service, and for any claims based on violation of law or infringement of any rights of any person or entity, including violation of publicity rights, defamation, or invasion of privacy.

Jocy’s makes no warranties, and disclaims any and all warranties, express or implied, concerning any offer furnished by third parties in connection with the Service. WITHOUT LIMITING THE FOREGOING, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND JOCY’S DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT.

Jocy’s is not responsible for technical, hardware, software, electronic, network, telephone, or other communications malfunctions, errors, or failures of any kind, including errors in transmission, traffic congestion, lost or unavailable network or phone connections, unauthorized human intervention, incomplete or inaccurate capture of entry information, or failed, incomplete, garbled, or delayed transmissions that may limit or restrict your ability to send or receive a message, including any injury or damage to your device relating to or resulting from participating in or using the Service.

Jocy’s reserves the right to modify this Agreement, or any part of it, or add or remove terms at any time, effective immediately upon posting. Your receipt of texts after such posting constitutes your acceptance of the modifications.

DISCLAIMER

Messages sent via SMS may not be delivered if your phone is out of range of a transmission site or if sufficient network capacity isn’t available at a particular time. Even within a coverage area, factors beyond your wireless carrier’s control may interfere with delivery, including your device, terrain, proximity to buildings, foliage, and weather. You acknowledge that time-sensitive messages may not be received promptly and that your wireless carrier does not guarantee message delivery.

APPLICABLE LAW

Your use of the Service under this Agreement is governed by the laws of the State of California.
